Court of Protection

The Court of Protection deals with matters affecting the health, welfare and financial affairs of individuals who lack capacity to make decisions for themselves. Following the Mental Capacity Act 2005 new legal duties have
been imposed.

At H.F.T. Gough & Co we have a wealth of experience and expertise dealing with Court of Protection applications and capacity issues.

We regularly lodge applications to appoint Deputies to deal with the property and financial affairs of individuals lacking capacity and our solicitors act as Deputies to assist those
lacking capacity. 

We also deal with applications relating to :

  1. Settlements
  2. Specific Issues
  3. Deprivation of Liberty matters
  4. Statutory Wills where an individual does not have sufficient capacity to make a Will Inheritance matter can be properly considered and arranged.

We strongly believe that the most vulnerable should be treated with dignity and respect. Applications to the Court can be made to ensure adequate care and treatment is received.
